The mission of the Colorado Energy & Carbon Management Commission (ECMC) is to regulate the development and production of oil and gas, deep geothermal resources, the capture and sequestration of carbon, and the underground storage of natural gas in a manner that protects public health, safety, welfare, the environment and wildlife resources.

The Enforcement team is tasked with determining Operator compliance with rules adopted by the Colorado Energy and Carbon Management Commission (ECMC) to protect public health, safety, welfare, the environment and wildlife resources. The team includes enforcement advisors, enforcement supervisors, an NOAV Specialist, and the unit manager.

Description of Job

The Enforcement Supervisor is responsible for the efficient and effective management of the ECMC enforcement program. ECMC’s enforcement program is implemented by Enforcement Advisors and Assistant Attorney Generals (AAGs) assigned to ECMC enforcement efforts. The Enforcement Supervisor supervises Enforcement Advisors and oversees AAGs (Prosecutors) who work with and advise various operational units (engineering, environmental, compliance, planning and permitting, and finance) regarding enforcement actions within their program areas. The Enforcement Supervisor also performs Enforcement Advisor functions.

The Enforcement Supervisor assists the Enforcement Manager to develop and implement policies for ECMC’s enforcement program to ensure compliance with applicable statutes, rules, regulations and orders (including the Act, the APA, Colorado Rules of Civil Procedure, the Colorado Open Records Act (CORA), and the Commission’s Rules and Regulations (Rules), 2 CCR 404-1). The Enforcement Supervisor is a resource for management, agency staff and the Commissioners for program decisions and policy direction related to the enforcement and compliance program with respect to regulatory and legal issues. The Enforcement Supervisor develops systems that directly impact the ECMC’s ongoing operations and is a key person in establishing and developing effective and efficient strategies and guidelines that impact the ECMC’s overall enforcement and compliance program.

The Enforcement Supervisor negotiates proposed resolution of enforcement matters with alleged violators. If a settlement is reached, the Enforcement Supervisor prepares a proposed Administrative Order on Consent (AOC) to be presented to a Hearing Officer, ALJ and/or the Commission for final approval. If a settlement cannot be reached, the Enforcement Supervisor is responsible for preparing and prosecuting the staff’s case against the alleged violator in an adjudicatory Order Finding Violation (OFV) hearing before a Hearing Officer, ALJ and/or the Commission. The Enforcement Supervisor may work closely with the AAG’s in prosecuting more complex cases. The Enforcement Supervisor supervises the other Enforcement Advisors who serve as prosecutors. The Enforcement Supervisor is responsible for assuring consistency of enforcement procedures, as well as consistency of penalties imposed for similar violations.

In conjunction with the financial unit, the Enforcement Supervisor tracks collection of penalties assessed by the Commission. The Enforcement Supervisor is the initial contact for collecting penalties, and recommends when uncollected penalties should be referred to State Collections for collection or legal action. In addition, this position seeks determination of responsible parties and pursues reimbursement of funds spent from the Oil and Gas Conservation and Environmental Response Fund as appropriate.

Manage Enforcement Actions :

  • Directly negotiate AOCs (settlement agreements) and prepare settlement documents to resolve enforcement actions in matters where the Attorney General’s Office is not involved.

  • Present and defend AOCs before a Hearing Officer, ALJ and/or the Commission.

  • In cases where the Attorney General’s Office is involved, participate in negotiations and assist in document formulation and drafting.

  • Prosecute alleged violations of the Rules, the Act and ECMC orders before a Hearing Officer, ALJ and/or the Commission, involving identification of witnesses and exhibits, preparation of witnesses, oversight of exhibits, preparation of direct and cross examination, opening statement, and closing argument.

  • Prepare proposed OFVs to present and defend before a Hearing Officer, ALJ and/or the Commission.

  • Provide policy, technical and legal assistance and guidance to agency staff in the operational units on the proper methods to gather facts, evidence and witnesses as background and evidentiary information for NOAVs, AOCs, and OFVs.

    Advise Director and Senior Leadership:

  • Consult with management to provide guidance and direction regarding the application of the enforcement program. Coordinate and prioritize enforcement matters for the CECMC by establishing strategies, systems, processes and guidelines to implement a comprehensive enforcement program.

  • Work with other CECMC units to develop a consistent approach to compliance and the initiation of enforcement actions.

  • Prepare statistical reports on the CECMC enforcement program as required by statute, executive order and Director requests.

  • Present to operators to communicate compliance goals in an effort to gain voluntary compliance and reduce enforcement actions initiated by CECMC staff.

    Supervise Enforcement Advisors:

  • Provides leadership and daily direction/supervision for the ongoing operations of the Enforcement Unit, including direct supervision of three Enforcement Advisors.

  • This position assists the Manager in deciding the processes and procedures necessary to administer all aspects of the Enforcement Unit.

  • Responsible for personnel management of subordinate unit members.

  • Includes signature authority, for actions and decisions that directly impact the pay, status, and tenure of four full-time FTE.

  • Position initiates and conducts all performance planning, mentoring, coaching/feedback and appraisals, recommends corrective/disciplinary action, and resolves informal grievances.

    Ensuring regulatory compliance:

  • Coordinate with the Enforcement Manager to develop, and implement, process improvements to the enforcement program.

  • Reviewing an existing NOAV and determining whether it is a priority for prosecution.

  • Evaluating Staff observations and deciding whether an NOAV is warranted or whether other measures designed to achieve compliance are appropriate.

  • Working with Staff to create a compliance tool specific to a discrete compliance issue, using the tool to issue warnings, and following up to ensure compliance has been achieved.

  • Actively tracking subordinate’s compliance with case deadlines, especially those designed to keep cases moving toward resolution .
